What you are agreeing to when I build and host a booking site for you. Written to be read, not skimmed. It is short.
Version dated 26 October 2026
These terms are an agreement between Evan Bradley Sherman, trading as hoopcoach.tools (“I”, “me”), and you, the coach or business claiming a site. By claiming a spot, by paying for a site, or by using a site I build for you, you agree to them.
A booking website for your training business, made up of:
I build it and show it to you before you pay anything. Paying for it is you saying it is what you want.
Monthly plan: $75 per month (early bird price). The early bird price is for the next 5 coaches who keep their site. After that the monthly plan is $100 per month. If you get the early bird price, it stays at $75 for as long as you stay on the monthly plan without a break. The first 5 coaches got a founder price of $50 per month, and it stays at $50 for them on the same terms. Stop any time by messaging me; you are not charged again, and the site comes down at the end of the month you have paid for. Months already paid are not refunded.
Annual plan: $750 per year (early bird price), paid up front. The early bird price is for the next 5 coaches who keep their site. After that the annual plan is $1,000 per year. This covers 12 months of hosting and upkeep from the day you pay. Message me any time before your renewal date if you do not want another year; you are not charged again, and the site stays up until your paid year runs out. Once paid, the annual plan is not refunded, in full or in part, because you have already seen and approved the finished site before paying. The one exception is in section 9: if I end this agreement early, you get back the unused months.
Plans renew automatically. Both plans renew on their own and charge the same payment method at the start of each new month or year, until you tell me to stop. You can stop any time by messaging me (an email or a DM is fine). Once you have told me, you are not charged again.
Failed payments. If a payment does not go through and is still unpaid 14 days later, the site goes offline until it is paid. I keep your bookings data for 30 days after the site comes down, then delete it, unless you ask for a copy first.
Price changes. I may change my prices for new coaches at any time. For you, a new price only applies from your next month or year, and only after I have told you at least 30 days before. A price you have already paid for never changes. This does not affect the founder and early bird price rules above.
No setup fee on either plan. Seeing your site built costs nothing.
If you pay for the annual plan, I design one custom logo for your business at no extra cost. It is optional. I make reasonable changes until you are happy with it. Once the annual plan is paid, the logo is yours to keep and use anywhere, for good, even if you later stop using your site. The logo is not offered on the monthly plan and has no cash value if you do not want one. Because it is part of a plan that is not refunded, receiving the logo does not change the refund rules in section 3.
The annual plan also comes with one custom domain for your site, a clean .com web address such as yourprogram.com, at no extra cost. You pick the name after you pay, and it has to be free to register at the normal .com price. I register it, connect it to your site and pay to renew it for as long as you stay on the annual plan. If you leave, I move it over to you so you keep it, and from then on you pay to renew it. On the monthly plan, a custom domain is $10 per month on top of your plan, on the same terms, and it stops being charged when your plan stops. If you move from the annual plan to the monthly plan, you keep your domain by adding that $10 per month. Like the logo, it has no cash value and does not change the refund rules in section 3.
Your stuff is yours. Your business name, logo, photos, prices, written content, testimonials, and every booking and customer record. I will never use your customer data for anything other than running your site.
The site itself: on either plan, I own the site and you have the right to use it for as long as you have paid for it. I keep the right to reuse the underlying template, code, and design on other coaches’ sites. Your site is built from a template I use for every coach; what you license is your instance of it.
Your content. You confirm you have the right to use everything you give me to put on the site: your logo, your photos, and any reviews or quotes. In particular: if a photo shows a child, you have the parent’s permission to publish it; and if a review is quoted from a message someone sent you, you have their permission to publish it with their name.
Your legal terms. Your site carries a Terms of Use page for your customers, covering things like liability, medical fitness, payment, and privacy. That page is a template I supply as a starting point. I am not a lawyer, it is not legal advice, and I make no promise that it is enforceable or adequate for your business or your country. You are responsible for having a lawyer where you operate review it before you rely on it. No terms of use can protect you from a claim for injury caused by negligence. Insurance does that, and holding it is your responsibility.
Your customers’ data. You decide what to collect and why. Under the privacy law where you operate, you are the one responsible for that data. I host it for you and do not use it. You handle requests from parents to see, correct, or delete their information, and you use the data only for running your training.
Your training. I have nothing to do with what happens on the court. I am not responsible for injuries, disputes with parents, refunds, or anything arising from the training itself.
Payments from your players. Card payments on your site run through your own Stripe account, under the terms between you and Stripe. If I help set it up, I can make payment links on your account, but the money goes from your players to Stripe to your bank and never passes through me. Venmo, Cash App, PayPal and cash go straight to you. However your players pay, you are responsible for your refunds, chargebacks and disputes, and for any tax on what you earn. I am not responsible for anything Stripe or a payment app does. Check the price on each pay link when I send it to you. If one is wrong, tell me and I will fix it; I am not responsible for payments taken at the wrong price before you told me.
Claims about your training. If someone makes a claim against me because of your training, your content, or the way you use your customers’ data, you agree to cover my reasonable costs of dealing with it.
The site is hosted on a third-party platform. I do not control that platform and cannot promise the site will never go down. If it does, I will get it back up as quickly as I reasonably can.
Changes. Bug fixes are always free. Small changes, such as your text, prices, photos or times, are included in your plan at no extra cost. Bigger work, such as a new feature, a redesign or a new page, depends on the job: I tell you before I start whether it costs anything and how much, and nothing extra is charged unless you agree.
No guaranteed results. The site, the email reminders and the growth guide are tools to help you get bookings. I do not promise any number of bookings, clients, views or income. What you get out of them depends on you and your market.
As it is. Apart from what this page promises, the site is provided as it is, without any other promise that it will suit a particular purpose or never have a fault.
The most I will owe. If something I did causes you a loss, the most I will owe you is the amount you paid me in the twelve months before the problem. I am not liable for lost bookings, lost income, lost data caused by the hosting platform, or anything indirect. This does not limit liability the law does not allow to be limited.
Either of us can end this agreement with 30 days’ notice in writing (an email or a message is fine). If you end it, section 3 says what happens to the site and your payments. If I end it early for a reason that is not your fault, I will give you a copy of your data, and on the annual plan I will refund the full months left on your paid year. I can end it straight away, with no refund, if you break these terms, for example by using the site for anything unlawful, not paying, or putting content on it you do not have the right to use.
This agreement is governed by the laws of the Province of New Brunswick, Canada. If we disagree about something, we talk first. These terms are the whole agreement between us about the site and replace anything said before them. I may update them; the version you agreed to is recorded with your claim, and a change only applies to you once you have accepted it.
